ISRA Case Management

The Industrial Site Recovery Act (ISRA) replaced New Jersey's Environmental Cleanup Responsibility Act (ECRA) in the early 1990s. ISRA applies to the environmental responsibilities of a regulated firm to conduct environmental investigations and remediation, if necessary, at the time of a property transfer.

The New Jersey Technical Requirements for Site Remediation (N.J.A.C. 7:26 E) form the basis for the investigation and cleanup of any properties that fall under certain Standard Industrial Codes (SICs) applicable to ISRA. New Jersey is proactive in encouraging the remediation of contaminated properties, having recently enacted a "Memorandum of Agreement" process under which the regulated and non-regulated community can conduct site cleanups at their own pace. Furthermore, the State has enacted Brownfields legislation which protects the future liabilities of non-responsible persons engaging in the cleanup process.
